Terms of Service
By commissioning Merelifluous, you agree to the following terms:
I. General Terms
⟡˖ ࣪ All commissions, unless with prior discussion and proper fulfillment of commercial rates, are for personal, non-commercial use only. Completed deliverables will be provided as high-resolution digital PNG files. No physical items will be shipped.⟡˖ ࣪ Commercial usages are to be negotiated, but must be mutually agreed upon by both parties prior to invoicing and payment. Details of commercial usage will be listed upon discussion and rates will depend on specified usage on the request forum.⟡˖ ࣪ Clients may not resell, trace, alter, or claim commissioned works as their own.⟡˖ ࣪ Commercial commissions are not available. Distribution for profit or to benefit non-profit entities or purposes is prohibited.⟡˖ ࣪ Reproductions or alterations of commissioned works for monetary purposes (including but not limited to merchandise, NFTs, blockchain, crypto, and artificial intelligence (AI) work or data training or resale) are NOT permitted. Violations will result in a permanent blacklist and loss of rights to the artwork.⟡˖ ࣪ Three (3) revisions are allowed at the sketch phase and one (1) at the rough colors stage. Additional backtracking and any extra revisions not previously discussed will incur an additional service fee.
II. Intellectual Property
⟡˖ ࣪ The artist, Merelifluous, retains full copyright and reproduction rights of all final art pieces, commissions, and new designs created.⟡˖ ࣪ The artist may post and feature commissions on social media and in portfolios for promotional purposes.⟡˖ ࣪ The client must properly credit the artist when displaying or sharing the commissioned artwork publicly by tagging the artist (@merelifluous).
III. Payment
⟡˖ ࣪ All payments are processed upfront in (USD — United States Dollar) through VGen's payment system.⟡˖ ࣪ Payment secures and reserves the client's commission request.⟡˖ ࣪ Any payments intended to purchase art not secured via VGen or Ko-Fi commissions will be treated as donations and are nonrefundable.
IV. Canceling & Refunding Policy
⟡˖ ࣪ The artist reserves the right to refuse, cancel, and refund commissions at any time. Full refunds will be issued if the artist cannot deliver.⟡˖ ࣪ Clients must discuss cancellation requests with the artist before any initial sketching and rendering has begun. No refunds will be provided after the sketch stage or upon completion of the commission.⟡˖ ࣪ Charge-backs filed against the artist will retract rights to the commission, and any attempts without prior discussion will result in a blacklist.
