Terms of Service

By commissioning Merelifluous, you agree to the following terms:

I. General Terms

⟡˖ ࣪ All commissions, unless with prior discussion, fulfillment of any commercial rates, or when the commission service labels the commission as including monetized content licensing, are for personal, non-commercial use only. Completed deliverables will be provided as high-resolution digital PNG files. No physical items will be shipped.⟡˖ ࣪ Commercial usages are to be negotiated, but must be mutually agreed upon by both parties prior to commissioning. General details of commercial usage will be listed upon discussion and additionally listed below.⟡˖ ࣪ Clients may not sublicense, resell, or distribute any commissioned works to third parties, whether for profit or for the benefit of non-profit entities. Tracing, altering, or claiming commissioned works as their own is also prohibited.⟡˖ ࣪ Reproductions, alterations, or any distribution of commissioned works for monetary purposes (including, but not limited to, unauthorized merchandising, NFTs, blockchain, cryptocurrency, artificial intelligence (AI) work or data training, or resale) are NOT permitted. Violations will result in a permanent blacklist and loss of rights to the artwork.⟡˖ ࣪ Three (3) revisions are allowed at the early sketch phase and one (1) at the rough colors stage. Any additional backtracking, extra revisions, or major changes not previously discussed will incur an additional service fee.

II. Intellectual Property

⟡˖ ࣪ The artist, Merelifluous, retains full copyright and reproduction rights of all final art pieces, commissions, and new designs created.⟡˖ ࣪ The artist may post and feature commissioned works on social media and in portfolios for promotional purposes. Clients may request that any public sharing—including work-in-progress images or final renders—be withheld until a later specified date.⟡˖ ࣪ The client must properly credit the artist when displaying or sharing the commissioned artwork publicly by tagging the artist (@merelifluous).

III. Payment, Canceling, & Refund Policy

⟡˖ ࣪ All payments are processed upfront through VGen's payment system. Payment secures and reserves the client's commission request. Proposals do not guarantee or reserve a commission spot.⟡˖ ࣪ Any payments intended to purchase art not secured via VGen or Ko-Fi commissions will be treated as donations and are nonrefundable.⟡˖ ࣪ The artist reserves the right to refuse, cancel, and refund commissions at any time. Full refunds will be issued if the artist cannot deliver. Partial refunds or revisions may be offered at the artist’s discretion, depending on the commission status.⟡˖ ࣪ Clients must discuss cancellation and refund requests with the artist before any sketching or rendering begins. No refunds will be provided after the initial sketch stage or upon completion of the commission.⟡˖ ࣪ Chargebacks filed without prior discussion will result in immediate loss of rights to the commission and a permanent blacklist. Clients are encouraged to contact the artist to resolve disputes directly before initiating chargebacks.
